1. Services
Elevate Digital Marketing provides Facebook Ads management, paid advertising, lead generation, analytics, strategy consulting, email and SMS marketing, and related digital marketing services.
2. SMS Communications
SMS consent is not a condition of purchasing any goods or services. We operate two SMS programs:
- Transactional: Appointment reminders and account alerts
- Marketing: Special offers and agency news (optional, consent-based)
Reply STOP to unsubscribe or HELP for assistance. SMS communications are restricted to individuals 18 years of age or older. Message and data rates may apply.
3. Acceptable Use
You agree to provide accurate information and to use our services only for lawful purposes. You may not use our services in any way that could harm, disable, or impair our operations or other users.
4. Intellectual Property
Content created specifically for your brand as part of a service agreement belongs to you upon full payment. All other website content, materials, and branding remain the property of Elevate Digital Marketing.
5. Limitation of Liability
Elevate Digital Marketing shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability for any claim shall not exceed the amounts paid by you for the specific services giving rise to the claim.
6. Warranty Disclaimer
Services are provided "as is" without warranties of any kind. We do not guarantee specific campaign outcomes, as results are affected by external factors outside our control.
7. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Governing Law
These Terms are governed by the laws of the State of Arizona. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
9. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.
